HOMEC+ Terms & EULA

SUMMARY

HOMEC+ ("we," "us," or "our") is owned and operated by Rhythmcs, LLC of Richmond, IN. By downloading or using HOMEC+, you agree to these Terms and to Apple's App Store terms. HOMEC+ offers subscription-based, cloud-hosted home-economics management with optional AI features and collaborative "Homes." Any collaborator you invite may enable AI on that Home's data—invite only trusted users.

1. Acceptance of Terms

By accessing or using HOMEC+, you agree to these Terms and to Apple's App Store terms of service. If you do not agree, you may not use the app.

2. Eligibility

HOMEC+ is intended for users aged 13 and older. We block registration attempts from users under 13. By agreeing, you represent that you meet the minimum age requirement.

3. License Grant

Subject to your compliance with these Terms, Rhythmcs, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use one (1) copy of HOMEC+ on a single Apple-branded device that you own or control, solely for your personal, non-commercial use.

4. License Restrictions

You agree not to, and will not permit others to, directly or indirectly:

  1. Copy or Distribute Reproduce, distribute, sublicense, rent, lease, loan, or otherwise transfer the app, in whole or in part.
  2. Modify or Derivative Works Modify, adapt, translate, or create derivative works of the app or any component thereof.
  3. Reverse Engineer Reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive or gain access to the source code.
  4. Remove Notices Remove or alter any trademark, logo, or proprietary notices embedded in the app.
  5. Circumvent Security Bypass or disable any security or technological measures in the app.

5. Ownership

All rights, title, and interest in and to the app—including all intellectual property rights—remain with Rhythmcs, LLC and its licensors. This license does not grant you any rights to Rhythmcs's trademarks, service marks, or logos.

6. Updates and Upgrades

We may from time to time provide updates, upgrades, bug fixes, patches, or new versions of the app ("Updates"). Unless we expressly provide a separate license, these Terms govern all Updates.

7. Subscriptions and Payments

Subscriptions are managed exclusively through Apple's App Store.

  • Auto-Renewal: Subscriptions automatically renew unless cancelled in your Apple ID settings at least 24 hours before the end of the current period.
  • Billing & Refunds: All billing inquiries and refunds are handled per Apple's standard policies.

8. User Accounts

You must register with a valid email, create a password, and provide your date of birth to enforce age restrictions. You are responsible for keeping your account credentials secure.

9. Collaborative "Homes"

  • Ownership & Access: The creator of a Home is its "Owner." Owners invite collaborators via unique codes—no public directory exists.
  • Data Sharing: Any collaborator you invite can view and edit that Home's data (name, optional address, bills, payments).
  • AI Warning: Any collaborator may enable AI features on shared Home data. To keep your data out of AI models, invite only trusted users.

10. AI Features

  • Optional Use: AI-powered insights (via Google Gemini) are disabled by default. You must explicitly enable AI each session.
  • Session-Only Processing: Prompts and AI responses are sent to Google Gemini but are never stored beyond the active session.
  • Privacy: We do not log AI interactions, nor do we share IP addresses, device IDs, or location data with the AI service.

11. Privacy and Data Hosting

HOMEC+ collects and stores data in U.S.-based Google Firestore servers. We collect: account info (name, DOB, email), Home info (name, optional address), bills, payments, and (opt-in) push-notification tokens. For full details, see our Privacy Policy.

12. Disclaimer of Warranties

HOMEC+ is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability

To the fullest extent permitted by law, Rhythmcs, LLC and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.

14. Termination

This license is effective until terminated. We may terminate it automatically and without notice if you fail to comply with any term herein. Upon termination, you must immediately cease all use of the app and destroy all copies in your possession.

15. Survival

Sections governing Ownership, Disclaimer of Warranties, Limitation of Liability, and accrued payment obligations survive termination.

16. Changes to Terms

We may modify these Terms at any time. Updated terms will be posted at https://www.homec.app/homecplus/terms with a revised "Last updated" date. Continued use after changes constitutes acceptance.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts of Wayne County, Indiana.
